1.Agreement

These Terms of Service ("Terms") form a binding agreement between you and How Machines Work ("we", "us", "our") governing your use of the interactive educational application, website and related content (together, the "Service").

By accessing or using the Service, you confirm that you have read, understood and agreed to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2.The Service

The Service is an educational web application that helps children understand how everyday machines work. It combines:

The Service is provided for general educational and entertainment purposes. While we take accuracy seriously, content is simplified for a young audience and should not be treated as professional, engineering or safety advice.

3.Parents, guardians and eligibility

The Service is intended for use by children under the supervision of a parent or legal guardian. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement of a parent or guardian.

By accepting these Terms, you confirm that you are a parent or legal guardian, or that you are an adult accepting on behalf of a child in your care.

Any subscription, purchase or account is held by the adult, not the child.

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the Service for private, non-commercial family purposes.

This licence does not permit you to:

Nothing in these Terms transfers ownership to you. All rights not expressly granted are reserved.

7.Third-party content & credits

Some of the 3D models used in the Service are created by independent artists and licensed to us under open licences, including Creative Commons Attribution (CC BY) and CC0 / public domain terms.

We credit each creator within the application, on the page for the relevant machine. Those attributions are a condition of the licences and must not be removed.

Third-party content remains the property of its respective owners. If you are a rights holder and believe content has been used incorrectly, please contact us and we will act promptly.

8.Payment and refunds

The Service currently offers a free tier. Paid plans may be introduced later. When they are:

Because the Service is digital content delivered immediately, some jurisdictions exclude a right of withdrawal once access has begun. Where that applies, we will ask for your acknowledgement before purchase — and we will still offer a fair refund window in practice.

9.Availability and changes

We aim to keep the Service available, but we do not guarantee uninterrupted or error-free operation. We may add, change, suspend or discontinue features — including individual machines or the Service as a whole — at any time.

If we permanently discontinue a paid feature you have paid for, we will provide a pro-rata refund or a reasonable alternative.

10.Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Content is simplified for children. It is not engineering, technical, safety or professional advice. Children should not attempt to disassemble, repair or operate real machinery based on the Service. Adult supervision is required for any hands-on activity.

We do not warrant that the Service will meet your specific educational requirements, or that content will be error-free. If you spot an inaccuracy, please tell us — we want to fix it.

11.Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Service.

Our total aggregate liability arising from or relating to the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD 50.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

12.Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service.

On termination, your licence ends immediately. Sections concerning intellectual property, disclaimers, limitation of liability and governing law survive termination.

13.Governing law

These Terms are governed by the laws of the jurisdiction in which we are established, without regard to conflict-of-law rules. Nothing in this clause deprives you of the protection of mandatory consumer laws in your country of residence.

Before starting formal proceedings, we ask that you contact us first so we can try to resolve the matter directly.

14.Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email or by a prominent notice in the Service, and the "Last updated" date will change. Continued use after an update constitutes acceptance.
